Terms of Service
These terms are an agreement between you and ProtoJoint AI ("we", "us"), 570 Hood Road, Unit 14, Markham, ON L3R 4G7, Canada, about ProtoJoint, the CAD application at https://protojoint.ai, its accounts, its paid plans and its AI features (together, the "Service"). By using the Service you accept them. If you use it for an organisation, you accept them for it and confirm you may.
1. Who may use ProtoJoint
You may use the free CAD without an account. To create an account you must be at least 13 years old, and at least the age of majority where you live (or have your parent's or guardian's permission) to buy a plan or credits. During the beta, accounts are by invitation. You are responsible for what happens in your account: keep your password to yourself, do not share your account, and tell us at support@protojoint.ai if you think someone else has used it.
2. The free CAD and your designs
The CAD runs in your browser, and your designs are saved on your own device. You own your designs. You give us the permission needed to run the Service for you (for example, to send a design summary or a picture of it to our AI provider to answer your request).
Contributions. On the free plan the designs you make are contributed to improve ProtoJoint's AI unless you turn that off; contributors, on any plan, also contribute their AI sessions. What is contributed, how it is kept and for how long are in the Privacy Policy. For what you contribute while contributing is on, you give us a non-exclusive, worldwide, royalty-free licence to store, copy, analyse and modify it to test and improve ProtoJoint's AI - its instructions, tools and checks - and for nothing else: we do not publish it, sell it or give it to anyone. The licence ends for a contribution when you delete it (Account › Privacy), except for what it already helped improve. Turn contributing off at any time; do not contribute designs you have no right to share, such as a client's confidential work or anything export-controlled - keep those to a plan without contributing.
3. Paid plans
- Plans. Maker, Pro and Max are monthly subscriptions, priced in US dollars on our pricing page. Sales tax, GST/HST or other taxes are added where they apply. Checkout may offer to charge you in your own currency instead, converted at the rate it shows; if you choose it, later monthly charges are in that currency too, so their amount can vary with the exchange rate.
- Two prices. Each plan has a contributor's price, when you contribute your designs and AI sessions (section 2), and a higher price when you do not. You choose at checkout and can change your choice at any time in Account › Privacy; the plan then renews at the other price from your next renewal, with no charge or credit for the current month. Before a change makes your plan dearer we show you the new price and ask you to confirm it, and we email you either way.
- Automatic renewal. A plan renews every month, and we charge your payment method at the start of each month, until you cancel. Before you subscribe we show you the price, how often you are charged, that the plan renews until you cancel and how to cancel, and we ask you to agree to these renewal terms; we then email you a confirmation of them. You can cancel online at any time, in one click, in Account › Plan & credits › Cancel subscription (or in Manage billing); the plan then stays active until the end of the month you paid for, is not charged again, and can be resumed until then. We email you a confirmation when you cancel.
- Changes. An upgrade takes effect at once and is charged for the rest of the current month (prorated). A downgrade takes effect at the start of the next month. We will tell you at least 30 days before a price change applies to you; you can cancel before it does.
- Failed payments. If a payment fails we retry it and tell you; the plan's monthly credits are not renewed until it is paid, and we may end the plan if it stays unpaid.
- Payments. Plans and credit packs are sold to you by Link, the merchant-of-record service of our payment processor, Stripe: Link takes your payment, works out and collects the tax that applies, sends your receipts and invoices and answers questions about a payment, and its terms for purchases sold through Link apply to the payment as well. You can see and manage your purchases at link.com as well as in ProtoJoint. We do not see or store your full card number.
4. Free trials
A first subscription may start with a free trial of 7 days. A trial needs a payment method and turns into the paid plan at its end unless you cancel before then. When it starts we email you a confirmation with the moment it ends, the price you will be charged after it and how to cancel, and we email you a reminder three days before it ends. Cancel online before the trial ends (Account › Plan & credits › Cancel subscription) and you are not charged. A trial includes a smaller number of AI credits than the paid plan, and they do not carry over. One trial per person: a trial may be refused or ended early, and the plan charged from the start, for an account, payment card or Link account that has had one, or for a prepaid card; we tell you this before you subscribe and email you if it happens.
5. AI credits
- The AI features use credits. What a request costs depends on the work the AI model does: the chat shows an estimate before you send a message and what it cost afterwards, and your account shows every charge.
- Each paid month of a plan comes with the plan's credits. What you do not use in a month carries over to the next paid month once, and ends with that month; credits of a free trial or of a plan given to you do not carry over. Credits are used in this order: carried over, the month's, bought. When a plan ends, its credits, those carried over included, end with it.
- Credit packs bought on top are used after the plan's credits and are valid for 12 months after your last purchase. They have no cash value, cannot be transferred, and are used only with a paid plan. We never buy credits for you automatically.
- You can limit your own use: in your account you can set a limit at which the chat stops a message (and the steps the AI takes for it), and one for each billing period. Neither is set unless you set it.
- To keep the Service fair and to stop runaway use, we limit how many requests and credits an account can use per minute and per day.
- A free account that contributes its designs and AI sessions gets a number of AI credits each calendar month, stated in the app; they do not carry over and end when it stops contributing or the month ends.
5a. Your own AI over MCP
Calls from an AI app you connect (MCP) use no credits. Max includes them without a monthly count, subject to the fair use limits above (a very high monthly number of calls, after which we ask you to write to us); Maker, Pro and a free account that contributes include a number of calls each calendar month to try it, stated in the app. Calls that never reach your open ProtoJoint tab are not counted.
6. Refunds
Fees are not refunded for part of a month, and credits that were used are not refunded, except where the law requires it. If you were charged by mistake, write to support@protojoint.ai within 30 days and we will put it right. Link may also refund a purchase in some cases, within 60 days of it. If a credit pack is refunded, its unused credits are removed. Where your local consumer law gives you further rights, these terms do not take them away.
7. Promotions, invitations and referrals
Promotion codes, invitation codes and referral rewards have the conditions stated when they are offered, one per person unless stated otherwise. A referral reward is earned when the person you invited pays for a first month; it is not earned for yourself (for example, by a second account or the same payment card). We may withdraw rewards and discounts obtained by abuse.
8. The AI features
- The AI may be wrong. It can misread a request, build the wrong geometry or report a wrong number. Check every design, dimension and calculation yourself before you rely on it, and do not rely on the AI for anything where an error could hurt someone.
- The AI is provided by third-party model providers (currently Anthropic). Your requests are sent to them to produce the answers, under their terms, and must follow their usage policies as well as ours.
- If you connect an outside AI app (for example Claude Desktop) to your account, you authorise it to read and change the design open in your ProtoJoint tab while you allow it. You are responsible for the apps you connect, and you can disconnect them at any time in Account › AI connections.
- We may pause the AI features of an account that breaks these terms or the Acceptable Use Policy, or while a payment dispute is open.
9. Acceptable use
You agree to follow the Acceptable Use Policy.
10. Our service
The Service, its software, design and brand belong to us or our licensors. We may change or improve it, and may stop offering a feature; if we stop offering a paid plan you have, we will tell you in advance and refund any prepaid part you cannot use.
ProtoJoint™, Eleph™ and the elephant mark are trademarks of ProtoJoint AI. You may name ProtoJoint to say what you made with it; do not use our names or marks in a way that suggests we sponsor or endorse you, or in the name of a product or service of your own.
11. Ending your account
You can delete your account at any time in Account settings; a subscription then ends at once and the current month is not refunded. We may suspend or close an account that breaks these terms, after notice where reasonable.
12. Disclaimers and liability
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or designs. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim. Some places do not allow these limits; where they do not, they apply only as far as allowed.
13. The law that applies
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules, and its courts have jurisdiction, except that if you are a consumer, the mandatory consumer laws and courts of the place you live still apply.
14. Changes to these terms
We may update these terms. We will tell you of material changes by email or in the app at least 30 days before they apply; continuing to use the Service after that means you accept them.
